Constitutional Case filed over Balluta ferry permit

Moviment Graffitti and Arnold Cassola have filed a Constitutional case regarding the controversial Fortina catamaran ferry permit in Balluta which is destined to change the swimming bay’s nature to a commercial port like the one in Sliema.

Plaintiffs are challenging the refusal to suspend the permit while the appeal is still ongoing, resulting in an unfair procedural advantage for the applicants and in a disadvantage and an impingement upon appellants’ right to accomplish an effective remedy.

In addition, plaintiffs are also challenging the Environment and Planning Review Tribunal’s decision to refuse the suspension of the permit on the basis that it was made by a Tribunal chaired by a Planning Authority’s employee – one of the case’s parties.

“The appellants do not have a guarantee that the Tribunal is impartial and independent – if it is presided over by a Chairperson who is the employee of a party to the case. Even this Constitutional right is being denied to appellants – which is why they are challenging this unjust practice” said a spokesperson.

Kawża Kostituzzjonali miftuħa kontra l-permess tal-katamaran fil-Balluta

Il-Moviment Graffitti flimkien ma’ Arnold Cassola fetħu kawża Kostituzzjonali dwar il-każ kontroversjali tal-permess tal-katamaran tal-Fortina fil-Balluta li huwa destinat li jibdel in-natura ta’ din il-bajja f’port kummerċjali bħal dak li hemm f’Tas-Sliema.

L-appellanti qed jisfidaw iċ-ċaħda li jkun sospiż il-permess waqt li l-appell għadu għaddej. Dan qed iwassal għal vantaġġ proċedurali inġust għall-applikanti u għal żvantaġġ u impatt negattiv fuq id-dritt tal-appellanti biex jinstab rimedju effettiv.

Barra minn hekk, l-appellanti qed jisfidaw ukoll id-deċiżjoni tat-Tribunal ta’ Reviżjoni tal-Ambjent u l-Ippjanar li tkun rifjutata s-sospensjoni tal-permess fuq il-bażi li din ittieħdet minn Tribunal immexxi minn impjegat tal-Awtorità tal-Ippjanar – waħda mill-partijiet fil-kawża.

“L-appellanti m’għandhomx garanzija li t-Tribunal huwa imparzjali u indipendenti jekk huwa ippresedut minn Chairperson li huwa impjegat ta’ waħda mill-partijiet fil-każ. Anki dan id-dritt Kostituzzjonali qed ikun miċħud lill-appellanti – huwa għalhekk li qegħdin nisfidaw din il-prattika inġusta” qal il-kelliem.
